Terms of Service

Damgha is built by a small team and sold to small businesses, so these terms are short and in plain language. Part A is the agreement with a shop that has an account. Part B is the short version for a customer holding a card — no account, no fine print.

Agreeing to these terms

Damgha (www.damgha.app) is operated by Unquestion LLC, a Wyoming limited liability company — 30 N Gould St, STE R, Sheridan, WY 82801, USA.

Using Damgha — as a shop, as a member of its staff, or as a customer holding a card — means you accept these terms and the Privacy Policy. If you do not accept them, do not use the service.

If you are accepting on behalf of a business, you confirm you are allowed to bind it.

Part A — for a shop with a Damgha account

Accounts

There is no sign-up. We create every merchant account and every staff account. You tell us who should have one and what they should be — an admin or a partner — and we make it.

  • You are responsible for everything done under your accounts, including by your staff.
  • Keep credentials private. One login per person — a shared login makes the stamp history useless as a record.
  • Tell us the day someone leaves so we can close their account. Until you do, their access is your responsibility.
  • An account holder must be 18 or over.

We may suspend an account for a breach of these terms, for non-payment, or where we reasonably believe there is a security problem. We will tell you why whenever we can.

What the service does — and what it does not

Damgha issues a stamp card into Apple Wallet and Google Wallet, records stamps, and delivers the card's updates to the customer's phone.

  • It is not a payment system, a point of sale, or an accounting record. It never touches money.
  • It depends on Apple, on Google, and on the customer's own phone. We cannot guarantee that a card installs, that it stays installed, or that a notification arrives — the wallet app and the phone's own settings decide that.
  • We may change, add or remove features. If we remove something you rely on, we will tell you first wherever we reasonably can.

Your customers are yours — and so is the duty to them

The customer list belongs to you. Export it in full, free, at any time, including after you leave. We will never hold it back and never charge for it.

With that comes the duty. For your customers' data you are the controller, which means:

  • You tell them what you collect and why, and you obtain any consent the law requires.
  • You honour a request to stop, to correct, or to delete — promptly.
  • You comply with the law that applies to you, including Egypt's Law No. 151 of 2020 where you operate in Egypt.
  • You use the list to run this card and to message your own customers about your own business — and for nothing else. You may not sell it, rent it, or hand it to anyone.

You may not use Damgha to collect payment card numbers, national ID or passport numbers, health information, or data about a child under 13 (under 16 in the EEA). A card is a name, a number and a count of stamps. Keep it that way.

We process that data as your processor, on your instructions, as described in the Privacy Policy.

Fair use

  • Do not stamp cards for people who were not there. A fabricated stamp is a reward you will owe, and it makes your own numbers a lie.
  • Do not use Damgha for anything illegal or deceptive.
  • Do not try to reach another merchant's data, probe our systems, or automate against our endpoints beyond ordinary use of the product.
  • Do not resell, sublicense or white-label access to Damgha without our written agreement.
  • Do not copy the product's code, design or brand.

The reward is your promise, not ours

Damgha records that a customer collected the stamps. What they get for it — a free coffee, a discount, whatever your card says — is between you and them. We are not a party to it, we do not hold value on anyone's behalf, and stamps are not money, credit, or a stored-value instrument of any kind.

Honour what your card says. If you change the reward, change it for cards issued after the change and honour what a customer was already promised. That is the whole thing that makes a loyalty card worth carrying.

Your logo, your words

Your brand stays yours. To run the service you give us a non-exclusive, worldwide, royalty-free licence to store, resize, recolour and display your logo, artwork and card copy — on the pass itself, in the wallet apps, and on the join and card pages.

You confirm you have the right to everything you upload and that it infringes nobody.

We may show your shop's name and card as an example in our own materials. Tell us you would rather we did not and we will stop.

What stays ours

The platform, its code, its designs, and the Damgha name and mark are ours. These terms give you the right to use the service — not to own any part of it.

Feedback. If you tell us how to make Damgha better, we may use that freely and without owing you anything. A product built with its first shops cannot work any other way.

Money

  • During the pilot, Damgha is free. Pilot shops lock their rate before public pricing lands.
  • After that: one flat price per location, month to month, in Egyptian pounds.
  • No per-customer fee, no setup fee, no export fee, and no charge per stamp or notification.
  • We will give at least 30 days' notice before a price change, and it applies from your next billing month.
  • Prices exclude taxes. Any tax that applies to you is yours to pay.

The pilot, and anything labelled beta

The pilot — and any feature we label beta — is provided as-is. It may have bugs, it may change, and it may be withdrawn. Do not build a business-critical process on a feature we have told you is beta.

Ending it

  • Month to month. Tell us and we close the account at the end of the current month.
  • Export your list before you go — we will help.
  • After you go, cards stop updating on customers' phones and we delete personal data as described in the Privacy Policy.
  • We may terminate for a serious or repeated breach of these terms, and immediately where there is a legal or security reason.
  • If we ever shut Damgha down, we will give at least 30 days' notice where we can, and every shop gets its list out first.

Apple, Google, and everyone else

Using Damgha means your card also lives under Apple's and Google's terms. They set the rules for their wallets, they can change them, and a change on their side can force a change on ours.

We are not responsible for a third-party platform's acts, outages or decisions — including a pass being rejected, delayed, or removed by the platform.

Confidentiality

Each side keeps the other's non-public information confidential, uses it only to do what these terms describe, and protects it with reasonable care. This does not apply to anything already public, independently developed, or required to be disclosed by law.

No warranty

Damgha is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows:

  • We are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost customers or lost goodwill.
  • Our total liability for any claim is capped at the greater of USD 100 or what you paid us in the 12 months before the claim. During the pilot, when you pay nothing, that means USD 100.

Nothing here limits liability that cannot be limited by law — including for fraud, or for death or personal injury caused by negligence.

Indemnity

You will defend and hold us harmless from claims arising out of your use of Damgha, your card designs and copy, the data you collect, the rewards you promised, and any breach by you of these terms or of a law that applies to you.

Things nobody controls

Neither side is liable for a failure caused by something outside its reasonable control — a platform or network outage, a power or internet failure, government action, or a natural disaster.

Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules, and the courts of Sheridan County, Wyoming have exclusive jurisdiction.

Before filing anything, write to support@unquestion.ai and give us 30 days to sort it out. Almost everything gets sorted in an email.

If you are a consumer, nothing here takes away a right your local law gives you that cannot be waived — including under Egyptian law where it applies to you.

Changes to these terms

We may update these terms; the date at the top changes when we do. For a material change we will tell every merchant by email at least 30 days beforehand, and continuing to use Damgha after that means you accept the new version.

The rest

  • These terms and the Privacy Policy are the whole agreement between us.
  • If one clause turns out to be unenforceable, the rest stands.
  • We may assign these terms to a successor entity — including the Egyptian company that will take over the service. You may not assign without our written consent.
  • We send notices to your account email address. Send yours to support@unquestion.ai.
  • Not enforcing a clause once does not waive it.

Part B — for a customer holding a card

Your card, in short

You do not have an account with us and you have not signed anything. This is the whole of what applies to you.

  • The card is free, and the shop issued it — not us. We are the plumbing that puts it in your wallet and keeps it current.
  • Your name and number are used to run the card and to let the shop message you about the shop. Nothing else. What the shop sends is the shop's decision — see the Privacy Policy.
  • Stamps are not money. They are the shop's promise, and the shop is the one who honours it. If a shop closes, or refuses the reward, that is between you and the shop — though write to us and we will take it up with them.
  • Use your own number. Joining with someone else's number, or collecting stamps you did not earn, gets the card stopped.
  • To stop the updates, remove the card from your wallet. To have your number deleted, ask the shop — or write to us and we will act and tell them.
  • We cannot promise a card always installs or that a notification always arrives. The wallet app and your phone's settings decide that.
